SCOTUS Filibuster: Yes, Chuck Schumer is That Crazy

In what can only be seen as a gift to Senate Republicans, Chuck Schumer announced today that Democrats will attempt to filibuster Neil Gorsuch’s nomination to the Supreme Court. Harry Reid and Senate Democrats gutted the filibuster for executive nominations during the Obama administration, leaving Supreme Court nominees as the only executive nominees that requires a cloture vote.

“After careful deliberation, I have concluded that I cannot support Judge Neil Gorsuch’s nomination to the Supreme Court…His nomination will have a cloture vote. He will have to earn 60 votes for confirmation. My vote will be no, and I urge my colleagues to do the same.”

Schumer and Bernie Sanders have slammed Gorsuch for “refusing to answer legitimate questions” like “will you overturn Roe v. Wade?” Gorsuch has impressed Republicans and Democrats alike for protecting the independence of the court by refusing to pick a side on potential future cases. Apparently that’s not good enough for Sanders and Schumer. In their world, SCOTUS nominees have to buy votes by making promises about cases that don’t even exist yet.

Robert Casey (D-PA) has also come out against Gorsuch for equally crazy reasons.

“We cannot demand perfection from Supreme Court justices. But we can demand a constant commitment to fairness, to protecting all Americans regardless of power or wealth, to that guiding creed: equal justice under law. I have concluded that Judge Gorsuch is not the right choice to fulfill this commitment.”

Notice there is nothing in his statement about an independent court, unbiased, or respect for the law. In the eyes of the Democrats, the law is not fair. Because Gorsuch has the gall to actually respect the law, that makes him a puppet of the evil rich oppressors, or some such nonsense.

The problem here is that Democrats don’t actually want someone to interpret the law, they want someone that will rewrite it. They know their agenda is too extreme to pass legislatively. They tried that in 2009 and the American people overwhelmingly kicked the Democrats out of power.

Liberals want to create a SCOTUS that forces their morality and their agenda on us, not a SCOTUS that forces government to respect the law as written through the democratic process. That’s why they dislike Neil Gorsuch, because he is dedicated to upholding the law and the Constitution as it is written.

While the Democrats are busy dreaming about a progressive leviathan court, Republicans are getting ready to use one of the most likable SCOTUS nominees in recent history as a vehicle to nuke the filibuster. This could be the most consequential thing to happen under President Trump, as it sets the stage for the GOP to shift the court to the right when Anthony Kennedy or Ruth Bader Ginsburg’s replacement only needs 50 votes for confirmation. We may not realize it yet, but for just a little while, Chuck Schumer gets to be a hero for pro-life Republicans everywhere.
